  
1. EditorialThe EnergySafe legislative programme continues to be developed in line with the decisions made by the Cabinet Finance, Infrastructure and Environment Committee during October 2001. The Board has been involved with reviewing the Electricity Act 1992 since it carried out its own review in 1997. Whilst the Board's review was superceded by a more broadly based one, which became the EnergySafe legislative programme, the Board has continued to be involved in the legislation development. Over recent months the Board has considered a number of proposals relating to the legislation development and those that are considered of high interest are summarised as follows: In line with the Cabinet decision to remove references to worker registration, licensing categories and criteria, the Board has agreed that if the Act is amended in accordance with the Cabinet decision, the Board will transfer the names of all persons who are in its database to new publicly available "lists" The lists will be divided into the names of those persons who are active in the industry (i.e. practising licence holders) and those who are inactive (i.e. registered or otherwise authorised people). Following the introduction of any amended legislation and at the completion of any transitional period the only people who will be entitled to have their names added to the lists will be those who uplift a practising licence. If at any time a practising licence holder lets their licence lapse, that persons name will revert to the inactive list. Any person whose name appears on the inactive list will have their name put on the active list when they uplift a practising licence. The Board supports the Cabinet decision that relates to amending the Act to make the maximum penalties for offences under the Act consistent with those under the Health and Safety in Employment Act. The Board does not see a need to amend the power of entry it has under present legislation. The present powers of entry were introduced in 1992 to replace those which were held by electrical inspectors who operated under the "Supply Authority" system. No proposals are contained in the EnergySafe programme to increase the Boards powers of entry. J Sickels Registrar
